The type of trust you use will  depend on who the beneficiaries are , what the assets are, and  how you want the assets to be distributed. Lasting Power of Attorney

There are two types Of LPA-Property and Financial affairs and Health and welfare

 

 

LPA Property & Financial affairs

A property and financial  affairs Lasting Power of Attorney takes care of your fincial affairs, property, money and assets. This means your chosen attorney can look after your financial affairs.An LPA can be set up to your requirements. If there is No LPA and you loose capacity there could be an impact on family. You would have apply to the Court of protection for a Deputyship order. This could take up to six months.

 

LPA HEALTH & WELFARE

A Health & Welfare LPA allows you to decide who makes decisions on your future care and welfare. This will come into force when  you are unable to make decision's. It gives your attorney the power to decision's decide where you live, medical care and life saving treatment.

 

The Attorney will only be able to make personal decision's once the LPA is registered and provided you cannot make personal decision's for yourself.
